Employment Equity Compliance & Reporting
Employment Equity Compliance & Reporting Assistance
Employment Equity is no longer something to look at a few days before the reporting deadline. Malfin SA helps employers understand their obligations, review their current workforce position, prepare their Employment Equity information, and work systematically through the reporting process.
2026 Reporting Window
The 2026 Employment Equity reporting period is open
The official Department of Employment and Labour online portal opened on 1 September 2026 for 2026 EE Reports (EEA2 & EEA4 forms). Online submissions close on 15 January 2027 at 23:59. Manual submissions close on 1 October 2026.
Questions Employers Ask
Are you prepared for the updated EE legal framework?
The Employment Equity Amendment Act operational changes and sectoral targets require designated employers to review their workforce profile, EE Plans, and consultation structures well in advance of submitting statutory reports.
Are we a designated employer?
Under the amended framework, employers employing 50 or more employees, organs of state, or entities designated by collective agreements must submit annual EE reports.
How do sector targets affect us?
Sector-specific numerical targets set expectations across top, senior, professionally qualified, and skilled occupational levels. Your 5-year EE Plan must align with applicable sector benchmarks.
Are our EEA2 & EEA4 records ready?
The EEA2 form details workforce demographic profiling and progress, while the EEA4 form reports remuneration differential details across occupational categories.
What is an EE Compliance Certificate?
Organisations seeking to tender for state contracts must demonstrate full EE compliance and obtain an official Employment Equity Compliance Certificate issued by the Department.
Is our EE Consultative Committee active?
Employers must consult regularly with employee representatives, maintain meeting minutes, and document genuine consultation before finalising their EE Plan and report.
Are we ready if audited by Labour?
Department of Employment and Labour inspections evaluate whether your EE Plan, EEA12 analysis, consultation minutes, and actual progress substantiate your submitted returns.
